The aim of the paper is to present all sorts of groups of bishops and levels of their autonomy in confrontation with primacy of the Pope. The conclusion is that the supreme, full, immediate and universal ordinary power of the Pope in the Church is not limited, but rather strengthened by the power of the bishops gathered together.

This article includes a deepened presentation and a commentary on some elements of the procedure of the election of the Pope, which underline the unity of the believers’ community. It is a unity in the sense of a participation of the whole Church in the election process, and secondly in that a special strengthening of the Pope to fulfill the ministry of unity of the Christ’s Church is accomplished by his election. The elements in question are as follows: entrusting of the election of the Bishop of the Church of Rome to the Cardinals of the Holy Roman Church, a majority of votes necessary for a valid election of the bishop of Rome, and a spiritual dimension of a conclave, as well as a calling directed to all the Faithful to participate in this special act.

The problem of papal primacy is one the most fragile issues between Catholics and Protestants. The author of the article discusses the possibility of a separation of the primacy of jurisdiction from the primacy of teaching. The method of reasoning follows the one of St. Thomas: first the arguments pro are given, and later the arguments contra. The arguments are from Catholic theology, Lutheran theology and philosophy. The answer is given from Ecumenical Perspective.

The article discusses the problem articulated in the title, but limiting the realm of discussion to three fields: law made by man, the Divine law, and human rights. First the author made an effort at answering the questions: Does the natural law exist?, and if yes, what exactly is it? The findings of the article are as follows: 1) human law is one of the forms of communication among rational humans, 2) every law must measure up to universal moral standards, 3) sense of justice, right and honest law are the fundaments of every man-made law.

The article consists of three parts in which the following topics are presented: 1) natural law, 2) invalidity of matrimonial consent, and 3) „and”.
In the first part the author focuses on the state of the present study on natural law in the Church and in the Catholic academic centers. The impulse for the research came from John Paul II’s speech, from 6th Feb. 2004, to participants of the session of the Congregation for the Doctrine of the Faith.
Next part includes the classification of the causes of invalidity of matrimonial consent. The special attention was paid to the discussion about the origin of canons: 1098 and 1103 CIC 1983.
At the end of the article, the author analyzes the relation, contained in the title of the article that obtains between natural law and invalidity of matrimonial consent. The deliberation took into consideration some circumstances in which matrimonial consent is expressed such as: respect for nature law, ethical order, and legal protection of act of will.

El artículo analiza la noción del consenso naturalmente suficiente ubicándola en el contexto de la noción jurídica del consentimiento matrimonial. Al distinguir ambos conceptos describe el efecto del consentimiento naturalmente suficiente en el caso de no contraer el matrimonio por causa del defecto de la forma canónica o por la existencia de un impedimento dirimente. Este efecto – habitual estado de voluntad como la base necesaria para la sanatio in radice y las circunstancias de hecho en las que puede aparecer – es el siguiente objeto de la análisis. La última parte expone la utilidad de la noción del consentimiento naturalmente suficiente y perseverante para encontrar un lazo adecuado entre los conceptos de la imposibilidad de cumplir e incapacidad de asumir las obligaciones esenciales del matrimonio.

A civil marriage of Catholics was rethought in the Church doctrine only in context of the plague of, so called, ”free unions”. The reason of this was the fact that a civil marriage brings some legally binding duties. Canon law considers such marriage not as invalid, but as not existing. The marriage has not matrimonium putativum status, because of the lack of the form of the celebration of marriage, which is compulsory.
The civil marriage cannot be validated in a simple way (sanatio simplex). The doctrine was confirmed recently by the Roman Rota. The marriage in question can be valid only in retroactive way (sanatio in radice), because the act of the competent authority includes required dispensation form canonical form of marriage.

The crisis of the faith of most of baptized and the secularist movements cause that the centuries-old tradition of the Church of the principle of inseparability between a contract and the sacrament is challenged again and is the subject of criticism, including the canonists. The study assumes the validity of the essential thesis of the inseparability. However, some issues relevant to this thesis (the right intention, the need for faith) are not so obvious, because they are raising many questions and doubts. The purpose of this presentation will not only provide the essential elements of the principle of the inseparability of the contract and the sacrament, but also to extract some inconsistency of this principle with the sacramentology and ecclesiology based on the teaching of the Second Vatican Council and its incohesion with the survival of the faith of the modern Christians. The pastoral demands will also be formulated.
