Skutki prawne reskryptu papieskiego udzielającego dyspensy od obowiązku celibatu kapłańskiego

Nel presente articolo, l’Autore commenta gli effetti giuridici del rescritto pontificio concedente la dispensa dall’obbligo del celibato sacerdotale. Egli propone di ordinare tutti gli effetti in tre gruppi, cioè: gli effetti principali connessi con la perdita dello stato clericale, di cui al can. 292 CIC/83; le proibizioni speciali, non connessi con la perdita dello stato clericale, di cui all’art. 5 delle Norme sostanziali Praeterquam aliis del 1980 (PA); e gli effetti aggiunti dal modello del rescritto pontificio del 2001. Inoltre l’Autore osserva che il modello del rescritto pontificio del 2001 modifica la normativa del 1980 per quanto riguarda gli effetti giuridici, soprattutto le cosiddette proibizioni (art. 5 PA). Il rescritto medesimo prevede anche la risoluzione del problema, il quale consiste nella domanda, da quale momento il rescritto pontificio sia efficace. Inoltre, l’Autore sottopone a critica la mancanza della promulgazione del modello del rescritto pontificio del 2001.

Thus, it entitles all interested parties to use the work under the following conditions:
- the author and the title of the work will be given,
- the place of publication (journal title and internet address of the originally published work) will be indicated,
- the work will be distributed in a non-commercial manner,
- no dependent works will be created.
