El reconocimiento del matrimonio canónico en el ordenamiento estatal

El artículo contiene reflexiones sobre distintos modos de recepción del matrimonio canónico en los ordenamientos jurídicos estatales. Tras una breve exposición de los sistemas matrimoniales, segen son clasificados por la doctrina, viene expuesto el sistema italiano y, comparando con éste, el polaco. El autor valora críticamente de la discrepancia existente entre la regulación de los efectos civiles del matrimonio canónico en el art. 10 del Concordato de 1993 y la legislación estatal polaca. Mientras la normativa del Concordato mismo entra en el marco del sistema “católico-concordatario”, en el que el Estado reconoce el matrimonio canónico como un instituto distinto del matrimonio civil y le atribuye los efectos civiles, las normas respectivas del “Código de familia y de tutela” polaco equiparan el matrimonio canónico al matrimonio celebrado en cualquiera de las formas religiosas previstas y lo tratan tan sólo como una forma religiosa de contraer el matrimonio civil, que es lo propio del sistema “anglosajón” o “protestante”.

Thus, it entitles all interested parties to use the work under the following conditions:
- the author and the title of the work will be given,
- the place of publication (journal title and internet address of the originally published work) will be indicated,
- the work will be distributed in a non-commercial manner,
- no dependent works will be created.
