Stwierdzenie stanu wolnego nieochrzczonych i niekatolików przed zawarciem małżeństwa kanonicznego

El articulo presenta los procedimientos necesarios para la verificacion de la validez de un matrimonio contraido en pasado por personas no bautizadas o acatolicas antes de admitirlas a celebrar el matrimonio canonico. Esta comprobacion es necesaria para averiguar la inexistencia del impedimento dirimente de ligamen procedente de derecho divino. La primera parte del trabajo analiza los factores influyentes sobre la creacion de un vinculo matrimonial valido en los matrimonios celebrados bajo distintos regimenes de derecho matrimonial religioso tanto cristiano como no cristiano. En la investigacion ordenada a la constatacion si existe o no existe este vinculo destaca la necesidad de la comprobacion de la influencia de las normas procedentes de derecho divino; de derecho religioso y tambien de derecho civil. La segunda parte del articulo enfoca el tema del procedimiento de esta comprobacion y las competencias atribuidas en este proceso al. parroco, al ordinario del lugar, al tribunal eclesiastico y a la Santa Sede.

- the place of publication (journal title and internet address of the originally published work) will be indicated,
- the work will be distributed in a non-commercial manner,
- no dependent works will be created.
