Functions of general clauses – Code of Canon Law 1983 as an example

The general clauses are an important part of a legislator’s workshop. Their functions offer him a wide range of opportunities. Unfortunately, there is a danger of misuse of the general clauses. The paper is an attempt at presenting the functions of general clauses in normative canonical texts – Code of Canon Law 1983 as an example. First, definition of a general clause is formulated, and, next, the demonstrations clauses are assigned to functions known from polish jurisprudence. At the end of the paper some postulates and guiding rules for a church legislator are formulated.References
