Parties to the administrative proceedings regarding the issuance of a decision on the permissible noise level (emission caused by the operation of church bells)

The article addresses issues related to determining the circle of parties in administrative proceedings concerning the issuance of a decision on the permissible noise level, with regard to emissions caused by the operation of church bells. It analyzes matters related to the addressee of such a decision and the concept of a party in administrative proceedings. Based on this analysis, the article identifies the range of entities that may hold the status of a party in the aforementioned proceedings. It also highlights the need to determine whether the emission caused by the ringing of church bells can be considered an element of the exercise of public worship. The considerations presented in the article indicate the existence of a broad group of entities that may become parties to administrative proceedings concerning the issuance of a decision on permissible noise levels in relation to emissions caused by the operation of church bells. This group primarily includes entities holding property rights to real estate, buildings erected on such land, and premises located within them that are affected by the sound of the bells. In addition to them, a party to such proceedings may also be any entity whose legal interest—regardless of whether it arises directly from property law—may be affected by the proceedings in question.
