Controversy surrounding the canonical concept of good faith

In this study, the author focuses on the issue of the canonical concept of good faith. By examining publications on this subject, he has shown that there is no consensus on this matter in doctrine. Supporting the majority view, he expressed the opinion that this concept is not uniform, as it has a two-dimensional nature: objective (possessory) in psychological terms and subjective (contractual) in ethical terms. Explaining this thesis, he noted that the idea of good faith in the contractual sphere differs from that which occurs in the institutions of prescription and putative marriage.
Another subject of the author’s reflection was the problem of the significance of the category of absence of sin in the structure of the category of good faith. Due to the disagreement among canonists on this issue, the author argued in favour of its legal value, justifying his thesis with the specificity of the canonical legal order.
