Anthropological-legal vs. psychological meaning of the positive act of will in Canon 1101 § 2 of the Code of Canon Law. The possibility of a paradoxical opposition

The term “positive act of will” in Canon 1101 § 2 of the CCL has a legal meaning flowing from its anthropological meaning. This act is the efficient cause of simulative exclusion, which produces a defect in the matrimonial consent and, as a result, the invalidity of the marriage. The term “positive act of will” also has its psychological connotations. The article describes a possible contradiction between the anthropological-legal and psychological meanings of the term. The one undertaking the exegesis of this term must precisely distinguish between its two meanings. Their mutual opposition may take place especially when the positive act of will from can. 1101 § 2 CCL is the so-called implicit virtual will. In the era of modern moral changes, it may be an increasingly frequent cause of simulation of the matrimonial consent.
