The canonical administrative proceeding: outline of the problematic through example as the legal value of proofs involving electronic communication

Given the main goal of the present paper, which was to determine the precise legal value of proofs relating electronic communication, the article studies the problematic concerning the formation and the formalization of the legal canonical proceeding. Considering that the entire ecclesiastical legal system characterizes by its administrative dimension, it was absolutely significant to study those procedures, which peculiar specifications in forming process were not given by the supreme legislator (atypicality of proceedings). The singular emphasis was given to the fact that nowadays, in the process of administrative decision making, the competent authority uses as a proof – indispensable in order to emanate the final decree – emails, text messages, posts published on Facebook or others social media web pages.The conclusion permitted to affirm that the correct assessment of their legal value would depend on authority’s discretionality subordination to the principle of legality.
