Bishop – Pastor and Iudex (in Relation to Dynamic Challenges Posed by Pope Francis)

The institution of a diocese bishop that forms a relationship with an evangelic picture of a good shepherd is – by the power of God’s law – connected with fulfilment of obligations of a judge in relation to an entrusted part of the people of God. This was significantly and practically reminded by the Pope Francis’s process reform, in recent years. At the same time, this is a practical fulfilment of a conciliar ecclesiology by the Pope that explicitly indicates that in a particularistic Church every diocesan bishop is Pater, Magister and Iudex. At the same time, when looking at bishops exercising judicial power from a historical point of view, it must be remembered that from the very beginning of the Church existence individual bishops vigorously involved themselves in exercising judicial power. Due to this, there are numerous historical facts that allow to better understand practical decisions taken by Pope Francis; as a historical excursus of bishops personally holding the institution of a judge is well documented in the sources. Thus, the matrimonial process reform of 2015 must be perceived in a broader historical context. There is no doubt that Pope Francis – as a result of his reform – wishes harmed people to find peace in their consciences by the Church providing a just and merciful service and that through a new sacrament of marriage, that is taken in a valid manner, these people successively become missionaries giving evidence of the sanctity of marriage and beauty of Christian family. In this manner, the Church should continue to go forward undertaking the not easy challenges of the present reality, especially, having regard to a spiritual well-being of a human and in the final perspective – his salvation. At the same time, a dynamic and very practical position of Pope Francis requires a fast and specific response from individual diocesan bishops.
