Analysis of the canonical form in the context of mixed marriage

Marriage was intended by God himself to be one of the ways to lead mankind to salvation. The fundamental and inalienable nature of this institution has been affirmed by the Church. From the very first centuries, the rules governing the contracting of marriages began to crystallize. Over time, a coherent procedure emerged, the observance of which is indispensable for the validity and dignity of sacramental marriage. In canon studies, this is referred to as the canonical form. The ordinary form of marriage, mentioned in the 1983 Code of Canon Law (canon 1108), is intended to protect the holiness and indissolubility of the marriage covenant. The Church never exempts Catholics from this form of marriage. Ecclesiastical legislation also requires this form for those who wish to enter into a mixed marriage in which one of the parties is baptised but belongs to the Church or to a community that is not in full communion with the Catholic Church. Only if there is a legitimate reason, a dispensation is granted to fulfil this obligation.
